‘Bad blood’ caused assault

A man suffered a cut eye, bruising, and lost a tooth, after being assaulted in the street.

The offence, which happened outside a Galashiels nightclub, was said to have arisen out of “bad blood between two families”.

Darren McMillan, 27, of Meigle View, Galashiels, admitted, while acting with others, assaulting a man by repeatedly punching him on the head and body, whereby he fell to the ground, and continuing to punch, him all to his injury, at Overhuagh Street, Galashiels, on October 7.

He also admitted possession of cannabis resin at his home on the same date.

Depute fiscal Tessa Bradley told Selkirk Sheriff Court on Monday that the victim left the Indigo night club around midnight and was approached by the accused and two others in Overhaugh Street.

Ms Bradley said there had been a separate incident earlier that evening, and McMillan punched the man, whose friend was pushed away when he tried to intervene.

Ms Bradley said the man fell to the ground and the assault continued. He managed to escape and was taken to Borders General Hospital by ambulance, where he was found to have a cut around his right eye, which had to be glued, and bruising.

“He also lost a front tooth,” added Ms Bradley.

Police attended at McMillan’s home with a search warrant, and found cannabis resin, which the accused said was for himself.

When he was asked about the assault, McMillan said he had punched the man two or three times.

“This is another incident arising out of bad blood between two families,” explained Ms Bradley.

Solicitor Ross Dow, defending, said McMillan had “joined in” the assault after his friend had an argument with the victim.

Sentence was deferred until April 8 for reports.
