Victim’s jaw was broken in three places

A MAN suffered three fractures to his jaw after kissing his attacker’s ex-girlfriend.

Mark Heath repeatedly punched the victim on the head in a Galashiels nightclub.

Heath, 21, of Duke Street, Galashiels, appeared on indictment and admitted assaulting a man to his severe injury at Move, Overhaugh Street, on December 18 last year.

Depute procurator fiscal Kate McGarvey said Heath was angered to see the victim kissing his former girlfriend and punched him three times on the face, before staggering out of the nightclub. The victim was advised to seek medical advice and the following day attended hospital.

“He had three fractures to his lower jaw and his teeth needed realigned,” said the prosecutor.

Heath was interviewed by police and admitted the assault. “He said that he saw the complainer kissing his ex-girlfriend and had had a lot to drink, and was very angry and punched him,” added Ms McGarvey. Heath said: “I’m sorry, I didn’t mean it.”

His lawyer, Kathleen More, said her client had written a letter of apology to the victim and deeply regretted his behaviour.

“He had been in a relationship with this lady for two years,” she added.

She said Heath, who works as a communications specialist, hoped to join the army.

Sentence on Heath was deferred until December 28 for reports.
