Glass attacker jailed for a year

A GLASS attack during a row over dog biscuits left the victim scarred for life.

And the man who threw the pint glass during a drinking session in his home has now begun a prison sentence of 12 months.

Robert Hyslop admitted the attack at his home in Jedburgh’s Howden Road on May 25. He was jailed by Sheriff Derrick McIntyre at the local court on Friday.

The 27-year-old lost his temper after someone knocked over a bowl of dog biscuits and hurled the glass which broke and struck his 52-yar-old friend on the left temple.

Procurator fiscal Graham Fraser said it had left a scar, although mainly in the hairline. He added that Hyslop told police he had not meant to hit his victim on the head and said it was the worst feeling when it happened.

Hyslop also pleaded guilty to a charge of playing excessively-loud music and shouting and swearing at police on October 8 at 5am.

Defence lawyer Ed Hulme said his client was full of remorse for causing the injury. He added that he had stopped having friends round to his house for drinks since May and had stopped drinking altogether since the incident in October.

Sheriff McIntyre jailed Hyslop for a year for the glass assault and imposed another two-month sentence, to run concurrently, for the breach of the peace at his home in October.

MURDER-BID ALLEGATION

A 26-year-old man is facing a charge of attempted murder.

John Grierson is accused of attacking Michael Mulholland, 30, in Hawick earlier this month.

Grierson made no plea during a brief private appearance at Jedburgh and was remanded in custody by Sheriff Derrick McIntyre.

Last week he was jailed for eight months and 15 days for injuring a man by striking him over the head with a glass object at the Scott Park in Galashiels.

TRIAL DATE FOR DRUG ACCUSEDS

TWO females have been accused of drug dealing in Kelso.

Elisha McEwen, 19, of the town’s Horsemarket, and Katie Fleming, 23, of Oxenrig Farm Cottages, Coldstream, both deny being concerned in the supply of cannabis between November 1 last year and May 24.

A trial date was fixed for March 13 with an intermediate hearing on February 14.

COMPENSATION AFTER TAXI ROW

A HAWICK couple who assaulted a father and daughter, thinking they were going to take their taxi, have been ordered to pay £600 in compensation.

Samantha James, 23, and Jamie Wilson, 26, of Ruberslaw Road, pleaded guilty to the offences following the early morning bust-up last month after leaving a public house.

Procurator fiscal Graham Fraser said James and Wilson had gone to a fast-food take away and had asked a taxi driver to wait for them.

He explained that Wilson had been carrying on inside the shop, with James apologising on his behalf.

When they came out of the shop, Wilson saw a 56-year-old man and his 20-year-old daughter speaking to the taxi driver.

Mr Fraser said: “They had just been chatting as the man knew the driver. However, the accused came out of the shop and misunderstood the situation, no doubt influenced by the drink taken.

“The man told Wilson to shut up and Wilson threw a punch at him. The daughter intervened and at this point James head-butted her, causing her nose to bleed.

“The parties were separated, but Wilson then ran back and got the man in a headlock.”

First offender James was ordered to pay £300 compensation to her victim, while Wilson was told to pay a similar sum as well as being put on a two-month, restriction-ofliberty order keeping him in his home between 7pm and 7am.

SHERIFF: YOU ARE A MENACE

A PENSIONER who admitted driving while double the legal alcohol limit has been banned while a sheriff awaits a social inquiry work prior to imposing a sentence.

Archibald Armstrong, 76, of Gordon Quarry, Gordon, pleaded guilty to the offence which happened on November 3.

Procurator fiscal Graham Fraser said the pensioner had a serious drink problem.

The fiscal revealed: “He told police he cannot come off alcohol or, in his words, he sees the monsters.”

He explained how Armstrong was refused further service in a public house due to behaviour and was asked to leave. An incident then developed with his car keys and a barmaid tried to block him leaving so she could get the keys off him.

Mr Fraser said: “Various efforts were made to prevent him going into the car and driving off, but he was persistent in doing that. He was seen drinking wine from an open bottle in the car.

“Thereafter he drove off erratically and the police were called. He drove down to Morebattle where the police found him in the vehicle.”

Sheriff Derrick McIntyre told Armstrong: “You are clearly a menace because you have a drink problem and you are driving about.”

He deferred sentence until January 17 for a criminal justice social work report to be prepared and imposed an interim driving ban.

DEALER NETTED IN POLICE STING

A GALASHIELS woman who supplied undercover police officers with drugs has been jailed for 13 months.

Christine Lauder, 45, pleaded guilty to supplying drugs with a total value of £90 at her Beech Avenue home earlier this year.

Defence lawyer Ed Hulme said she had been the subject of a four-month police undercover operation.

He added that all they had on her was supplying relatively-small quantities of drugs.

Her husband, Mark Lauder, 50, received a 12-month prison sentence recently for a similar offence.

COURT DATE FOR DANGER DRIVER

SENTENCE was deferred for a personal appearance on a Selkirk man who admitted driving dangerously.

John Baird, 63, of Heatherlie Terrace, pleaded guilty to overtaking a vehicle on the Peebles-Leadburn road on September 24 when it was not safe to do so, and forcing a vehicle coming in the opposite direction to take evasive action.

The case will recall on January 6.

RUBBISH NIGHT LEADS TO COURT

BEING drunk and knocking a litter bin across a roadway after being assaulted at a rowdy party in Galashiels on Friday was in breach of Daniel Stewart’s ASBO (antisocial behaviour order).

The 23-year-old, now living at Inchmyre, Kelso, pleaded guilty to the offence, committed in King Street, when he appeared from custody.

Depute fiscal Tessa Bradley said: “Throughout the evening on Friday the police were getting repeatedly called out for noise complaints at The Pirns in King Street, where the occupant of one of the flats was having a loud party.

“Eventually the person was told to ask his friends to leave and Stewart was one of them. He said he was going to his father’s house and was extremely intoxicated. He was seen by officers at the junction of King Street and Wheatlands Road as officers were in attendance nearby dealing with a separate matter.

“They could see the accused staggering about before coming across a rectangular litter bin and pushing it over with both hands, causing rubbish to spill over the roadway.”

He was arrested at 10.30am, taken to Galashiels police station and charged.

He told police he had taken diazepam that evening, the court heard.

Lawyer Mat Patrick said his client – sporting a black eye in the dock – was angry after being assaulted at the party.

The lawyer added: “He now stays in Kelso as he wants to distance himself from the people he was getting into trouble with.”

Sheriff Peter Paterson imposed a six-month community payback order involving 60 hours of unpaid work.

BAIL FOR MAN ON KNIFE CHARGE

A GALASHIELS man has appeared in private at Selkirk Sheriff Court accused of carrying a knife on Friday night in Galashiels.

Andrew Gillies, 30, made no plea or declaration and the case was continued for further examination. Gillies was released on bail.

ACCUSED FACES THREE CHARGES

A GALASHIELS man has appeared in private at Selkirk Sheriff Court charged with possessing class A and B drugs with intent to supply.

John Mein, 49, faces three allegations under the Misuse of Drugs Act.

He made no plea or declaration and his case was continued. Mein was granted bail.
