A PENSIONER was left unconscious after being attacked in the street, Jedburgh Sheriff Court heard last Friday.
His assailants avoided jail with an alternative sentence of a community payback order (CPO) when they appeared before Sheriff Donald Corke.
Kathryn Parr, 52, of Bolem Gardens, Wallsend, was found guilty after trial of assaulting the 69-year-old victim at Abbey Bridge End, Jedburgh, on September 2. Co-accused Gary Naisbitt, 44, of Deneholm, Wallsend, pleaded guilty to the assault.
The elderly man was punched on the head, knocked to the ground and rendered unconscious.
Parr, assessed not fit for work, was sentenced to a two-year CPO, while Naisbitt received a one-year CPO with a condition he completes 200 hours of unpaid work. Each was ordered to pay the victim £250 compensation.
“This was a serious offence involving an elderly man and the two of you should have known better than to set about him,” Sheriff Corke told the accused, adding: “You could very easily have ended up with a custodial sentence.”
